Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Pathway2College (“Pathway2College,” “we,” “us,” or “our”) governing your access to and use of pathway2college.org and our related services (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and Parental Consent

You must be able to form a binding contract to use the Services. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Services. By allowing a minor to use the Services or by submitting a minor’s information, a parent or guardian agrees to these Terms for that minor.

Description of the Services

Pathway2College presents a curated roster of student athletes to college coaches and programs, and offers recruiting workshops, academic preparation resources, and optional athlete profile hosting. Roster placement is determined by Pathway2College and is not a public application. Some athletes are identified by our staff, and families may also connect with us through our workshops and choose to have an athlete featured.

No Guarantee of Recruitment, Scholarships, or Results

We provide exposure, evaluation, and education. We do not control college coaches or admissions or athletic departments, and we do not guarantee recruitment, roster spots, offers, scholarships, financial aid, playing time, or any specific outcome. Any statistics or examples are for illustration only.

Athlete Content and License

Athletes and their families are responsible for the accuracy of the information and media they provide. You represent that you own or have the necessary rights to all content you submit, including video, images, statistics, and the athlete’s name, image, and likeness, and that sharing it with us does not violate any third party rights or any school, association, or league rule.

By submitting content, you grant Pathway2College a non-exclusive, royalty-free license to host, display, reproduce, and share that content with college coaches and programs and to promote the Services, for as long as the athlete is featured with us. You retain ownership of your content, and you may request that we remove a profile or specific content by contacting us.

Fees, Payments, and Refunds

Recruiting workshops are offered free of charge unless stated otherwise. Certain services, such as academic preparation or optional athlete profile hosting, may carry a fee that is described at the point of purchase. Prices and fees may change. Unless a specific offer states otherwise, fees are due at purchase and refunds are handled on a case by case basis. Payments are processed by a third party payment processor, and your use of that processor is subject to its terms.

Acceptable Use

You agree not to misuse the Services, including by submitting false, misleading, or infringing content, impersonating others, harassing anyone, attempting to gain unauthorized access, interfering with the operation of the Services, or using the Services for any unlawful purpose.

Intellectual Property

The Services, including their design, text, graphics, and logos, are owned by Pathway2College or its licensors and are protected by applicable law. Except for content you submit, you may not copy, modify, distribute, or create derivative works from the Services without our written permission.

Third-Party Services and Links

The Services may link to or integrate third party sites and tools. We are not responsible for third party content, products, or practices, and your use of them is at your own risk.

Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Pathway2College and its owners, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, or data, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to us in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold harmless Pathway2College and its owners, staff, and affiliates from any claims, damages, and expenses, including reasonable attorney fees, arising out of your use of the Services, your content, or your violation of these Terms or any law or third party right.

Termination

We may suspend or end your access to the Services at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination will survive.

Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. You agree that the state and federal courts located in Bexar County, Texas will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to that venue.

Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page with a new date. Your continued use of the Services after changes are posted means you accept the updated Terms.

Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Pathway2College regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
